Terms of Service
1. Acceptance of these terms
These Terms of Service form an agreement between Jobwright, Inc. ("Jobwright", "we") and the business that opens an account ("Customer", "you"). By creating a workspace, being invited to one, or using the service, you agree to these terms. If you're agreeing on behalf of a company, you represent that you're authorized to do so.
2. The service
Jobwright is a hosted software console for scheduling jobs, dispatching technicians, managing work orders, and creating quotes and invoices. We provide it on a subscription basis and may add, change, or remove features over time. We aim to keep the service available around the clock, but we don't guarantee uninterrupted operation.
3. Accounts, seats, and users
You're responsible for your workspace, the users you invite, and keeping login credentials secure. A technician seat is required for each person who runs jobs in the field on the Jobwright mobile app. Dispatchers, office staff, and owners who use only the console do not consume a billable seat. You're responsible for all activity under your workspace.
4. Fees and billing
- Per-technician pricing. Subscription fees are charged per technician seat on your chosen plan, billed monthly or annually in advance.
- Free trial. New workspaces may start with a 14-day free trial. At the end of the trial, continued use requires a paid subscription.
- Changes to seats. Adding a seat is prorated for the current period; removing a seat credits unused time toward your next invoice.
- Renewals. Subscriptions renew automatically for the same period unless you cancel before the renewal date. Fees are non-refundable except where required by law.
- Payment processing. On-site payments collected through Jobwright Payments are subject to the processor's fees disclosed at sign-up.
5. Acceptable use
You agree not to misuse Jobwright. In particular, you will not: use it to break the law; send messages you don't have consent to send; upload malware; attempt to breach security or access another workspace's data; resell the service without our permission; or use it in a way that degrades the service for others.
6. Your data
You own the data you put into Jobwright — your customers, jobs, work orders, and invoices. You grant us a limited license to host and process that data solely to provide and improve the service. We handle it as described in our Privacy Policy. You can export your data to CSV at any time, and we'll make it available for export for 30 days after your account closes.
7. Messaging and customer consent
Jobwright can send text messages to your customers on your behalf. You are solely responsible for having the necessary consent to contact your customers and for complying with applicable messaging and telemarketing laws. We provide opt-out handling, and you agree to honor opt-outs and to stop messaging anyone who has withdrawn consent.
8. Warranties and disclaimers
We provide Jobwright "as is" and "as available". To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the service will be error-free or that ETAs, routing, or scheduling suggestions will be accurate in every case — they're aids to your judgment, not a substitute for it.
9. Limitation of liability
To the fullest extent permitted by law, neither party is liable for indirect, incidental, special, or consequential damages, or for lost profits or revenue. Our total liability for any claim arising out of these terms is limited to the amount you paid us for the service in the 12 months before the claim.
10. Term and termination
These terms apply while you use Jobwright. You may cancel at any time from the console; cancellation takes effect at the end of your current billing period. We may suspend or terminate the service for a serious or repeated breach of these terms, or if required by law. On termination, your right to use the service ends and, after the export window, we may delete your data as described in the Privacy Policy.
11. Governing law and disputes
These terms are governed by the laws of the State of Ohio, without regard to its conflict-of-laws rules. The state and federal courts located in Franklin County, Ohio have exclusive jurisdiction over any dispute that isn't resolved informally.
